    When posting positions, advertisers/employers must agree to the following:
  • The Society for Healthcare Strategy & Market Development of the American Hospital Association (hereafter "SHSMD") hereby grants you a limited, terminable, non-exclusive right to access and use the SHSMD Career Center only for your internal business use seeking candidates for employment. This authorizes you to view and download a single copy of the material on the site solely for your personal use directly related to searching for and recruiting job prospects. SHSMD also grants you a limited, terminable, non-exclusive license to use the SHSMD Materials and Services for your internal use only. SHSMD reserves the right to suspend or terminate your access and use at any time if SHSMD determines that you are in breach of these terms, the Terms of Use, or Privacy Policy.
  • Company understands and agree that SHSMD owns and has the right to collect, extract, compile, synthesize, analyze, and publicly share job posting data and information. SHSMD may use such data and information for any lawful business purpose without a duty of accounting to you. "Data and information" shall include, but is not limited to, information regarding job seeker educational or career history (including, by way of example and not limitation, data relating to job seeker occupation, location, salary, education and experience) as well as the job posting itself. Employers who do not wish for their anonymized job descriptions to be included on the SHSMD website as a resource to SHSMD members are asked to e-mail shsmd@aha.org and reference "SHSMD Job Description Template Opt-Out" in the subject.
  • The Company shall be responsible for the accuracy, timeliness, completeness and removal of any employment requirements that are placed on the Society for Healthcare Strategy & Market Development system.
  • The Company shall present on Society for Healthcare Strategy & Market Development only genuine existing employment requirements with the Company.
  • The Company may not transfer or assign for any reason any products or services or rights to any products or services (including access to or contents of the Resume Database) provided by Society for Healthcare Strategy & Market Development to any third party without the expressed written authorization of Society for Healthcare Strategy & Market Development.
  • Society for Healthcare Strategy & Market Development reserves the right to receive job advertisements via the Internet from any approved Job Advertising Distribution services provider that it deems as acceptable; conversely it retains the right to disallow and deny job advertisements from entities that are not suitable for Society for Healthcare Strategy & Market Development's purposes.
  • Society for Healthcare Strategy & Market Development assumes no responsibility or liability for any personnel selected by the Company and the Company represents that any selection, retention or hire of any individual or entity is based solely on the Company's investigation, verification and determination that such hire is suitable for the Company's purposes.
  • Company represents, warrants and covenants that any Company materials provided by Company for use in connection with the services will not violate any laws or regulations or third-party proprietary rights, including, without limitation, copyright, trademark, obscenity, rights of publicity or privacy, and defamation laws. Company hereby grants SHSMD a non-exclusive, worldwide, royalty-free license to use the Company materials and to hyperlink to Company's website in connection with the services.
  • The Company agrees to hold harmless Society for Healthcare Strategy & Market Development from any claims, damages or losses incurred by the Company or any other party as a result of use of the Society for Healthcare Strategy & Market Development system.
  • Society for Healthcare Strategy & Market Development reserves the right to remove or deny any job posting(s) or advertisement for any reason, including if an arrangement for the billing process has not been met within a 24-hour period of posting.
  • Society for Healthcare Strategy & Market Development reserves the right to edit all employment advertisements, but will review any such edited advertisements with the Company prior to publication.
  • No advertisement submitted by the Company shall reflect, imply or contribute to any discriminatory actions, practices or improper bias. Society for Healthcare Strategy & Market Development reserves the right to edit any advertisement to remove any such offending language or implication.
  • The Company shall take sole responsibility to assure that the content of its advertising is true and accurate and conforms to all applicable laws, standards and regulations and the Company represents and warrants to Society for Healthcare Strategy & Market Development that it has all necessary authorization for the placement of the entire content of its advertising within the site. Society for Healthcare Strategy & Market Development may however decline any advertising or discontinue further publication of any advertising, at any time and for any reason, and shall not be liable in any manner as a result of such action, except to refund a prorated portion of any unused prepaid subscription.
  • Society for Healthcare Strategy & Market Development's liability for any claims of any nature whatsoever arising under this agreement or otherwise, shall be limited to the money paid to Society for Healthcare Strategy & Market Development by company for the specific service giving rise to such liability. This limitation of liability is cumulative and not per incident. In no event shall Society for Healthcare Strategy & Market Development be liable for any incidental, special, or consequential damages, lost profits, or lost or damaged data, or any indirect damages, whether arising in contract, tort (including negligence), or otherwise, even if Society for Healthcare Strategy & Market Development has been informed of the possibility thereof.
  • Advertisements submitted by the Company must be in compliance with all applicable equal employment opportunity laws including the anti-discrimination provision of the Immigration and Naturalization Act.   • Society for Healthcare Strategy & Market Development shall, under no circumstances, be liable for any direct, indirect, incidental, special, punitive or consequential damages that may result from the use of this site, including, without limitation, use or reliance upon any information contained on this site, interruptions, errors, defects, omissions non-delivery of information, disclosure of communications or any other failure of performance of any kind. You agree to release Society for Healthcare Strategy & Market Development, its members, directors, and employees from all claims, causes of action, lawsuits, liability, damages or other responsibility, known and unknown, anticipated or unanticipated, from the beginning of time until the present, arising out of your use of any Society for Healthcare Strategy & Market Development website or the content contained therein. You agree to indemnify Society for Healthcare Strategy & Market Development, its members, directors, and employees and hold them harmless from any cost, claim, liability or expenses (including reasonable attorneys' fees and related costs) arising out of or relating in any manner to your (i) violation of this agreement or (ii) use of the Society for Healthcare Strategy & Market Development web site.
  • SHSMD may revise these terms at any time. Changes will be binding on you on the date they are posted on the site (or as otherwise stated in the any notice of such changes). Any use of a site will be considered acceptance by you of the then-current terms, Terms of Use, or Privacy Policy. If at any time you find these terms unacceptable, you may not use the applicable site any longer. Any new or different terms supplied by you are specifically rejected by SHSMD unless SHSMD agrees to them in a signed writing specifically including those new or different terms. SHSMD may change the site at any time.
